Supreme Court Blocks OSHA’s Vaccine or Test Mandate, Allows Rule for Health Care Workers

The Supreme Court ruled today, January 13, 2022 to block the OSHA vaccine track or test mandate for employers. The OSHA Emergency Temporary Standard (ETS) mandate would have required companies with 100 or more employees to track proof of vaccination against COVID-19, or require weekly testing. Currently, it is up to individual companies as to whether or not to enact vaccination or testing policies. Companies can utilize the Certifications & Notifications features in California Payroll’s HR System to track vaccination and testing status if they have applicable policies. The Court did uphold the rule requiring vaccinations for workers in Health Care facilities that receive Medicare and Medicaid funding from the federal government.
