U.S. Supreme Court to Review OSHA’s ETS in January 2022

The recently re-approved OSHA ETS that applies to companies with 100 employees or more is heading to the Supreme Court for review. Last week, the U.S. Supreme Court announced that it has scheduled to hear arguments relating to the OSHA ETS on January 7, 2022. The court said that it will not make a decision on blocking the initiatives until all arguments are heard. Once arguments have been heard, it is expected that a final decision will be reached quickly. California Payroll will continue to monitor these events and their outcomes. In the meantime, California Payroll Clients are able to utilize our payroll system’s Certification tracking features within the HR module to keep track of their employees’ proof of vaccination, or view and receive notifications when an employee is due for another COVID test and record those results. Please Note: Guidance has not been provided by OSHA or the current administration on any reporting requirements employers may be required to provide in the future regarding OSHA’s ETS.
